Kurdistan Region Judicial Council issues statement on latest ruling of Iraqi Federal Supreme Court

ERBIL (Kurdistan24) – Abdul-Jabbar Aziz Hassan, the head of the Judicial Council of Kurdistan Region, on Wednesday issued a statement on the latest ruling of the Federal Supreme Court of Iraq on the issue of quota seats.

“There is no reason to change the constitutional articles of the Kurdistan Region because they are already constitutional. Everyone, including the Iraqi Federal Supreme Court, must abide by these articles. The Federal Court should not create problems or violate them under false pretenses,” the statement said.

The statement also noted that despite the fact that its establishment is contrary to the provisions of Article 92 of the constitution and Federal Court Law No. 30, it is the right of the Kurdistan Region to exercise its constitutional rights within the framework of the Iraqi state, but not the Iraqi Federal Supreme Court. Despite being amended in 2005, it exceeded its legal powers under the constitution.

“According to its decision No. 83 of 2024, which repealed the last amendment to law No. 1 of 1992, it has given itself the right to interfere in everything in the region. Upon examining the decision further, it is evident that it violates the constitutional provisions under which it operates,” the statement added.

As per Article 36 of the Kurdistan Parliamentary Election Law, five seats were reserved for Chaldeans, and Assyrians, one for Armenians and five for Turkmens, but the Federal Supreme Court of Iraq annulled the 11 seats on Feb. 21.

Kurdistan Region President Nechirvan Barzani on March 3, set June 10 for parliamentary elections.

Every four years, Kurdistan Region parliamentary elections are held to elect the 111 members. The election was first held in 1992 and the most recent election was held in 2018.

Dawid Salman, the Director of the Iraqi Independent High Electoral Commission, previously told Kurdistan24 that there are 3.6 million eligible voters in the Kurdistan Region.
